Members confirm they own or have permission to use all submitted content. They grant Sakhi a non-exclusive right to publish, resize and promote such content. Members remain responsible for copyright and trademark compliance.

5. Platform Role & Disclaimer

Sakhi provides visibility and promotional services only. Unless expressly stated, Sakhi does not verify, certify, endorse or guarantee businesses, products or services. All transactions are solely between buyers and sellers.

6. Business Owner Responsibilities

Businesses must comply with all applicable laws, licences, taxes and consumer protection requirements and keep listing information accurate and updated.

7. Customer Responsibilities

Customers should independently evaluate businesses before making purchases. Sakhi is not a party to transactions.

8. Advertising & Promotional Services

Advertising positions, visibility and campaigns may vary. No guarantee of enquiries, sales, rankings, leads, ROI or business growth is provided.

9. Website Development & Digital Services

Services are delivered according to the agreed scope. Additional revisions or enhancements may incur additional charges.

10. Membership Fees, Payments & Refunds

Fees are generally non-refundable once work has commenced, digital assets are created or advertisements are published, unless required by applicable law.

11. Privacy Policy

Personal information may be collected and processed for registration, communication, billing, support, marketing, legal compliance and service delivery. Sakhi will take reasonable measures to protect personal information.

12. Communication Consent

By registering, you consent to receive calls, WhatsApp messages, SMS and emails regarding services, updates and promotions. You may opt out of promotional communications where legally applicable.

13. Prohibited Activities

Illegal, misleading, defamatory, obscene, infringing or fraudulent content is prohibited.

14. Suspension & Termination

Sakhi may suspend or terminate accounts or listings that violate these terms or applicable laws.

15. Limitation of Liability

To the maximum extent permitted by law, Sakhi shall not be liable for indirect, incidental, consequential or business losses arising from use of the platform or transactions between users. Please see separate section below for further details.

16. Indemnity

Members agree to indemnify and hold harmless Sakhi, its founders, employees and representatives against claims arising from their content, listings or business activities.

17. Governing Law & Jurisdiction

These terms are governed by the laws of India. Disputes shall be subject to the courts having jurisdiction where Sakhi’s principal office is located.

Limitation of Liability

1 Platform Role

Sakhi Foundation (“Sakhi”) operates solely as a business promotion, networking, advertising and marketplace platform that enables businesses to showcase their products and services and allows customers to connect directly with such businesses.

Unless expressly stated otherwise in writing, Sakhi is not the manufacturer, seller, supplier, distributor, retailer, importer, exporter, reseller, agent, broker, franchisee, dealer, employer, contractor or representative of any listed business.

Sakhi merely provides an online platform to facilitate visibility and communication between businesses and customers.

2 Independent Transactions

All enquiries, communications, quotations, negotiations, orders, payments, contracts, deliveries, warranties, returns, exchanges, cancellations, refunds and after-sales services are conducted solely between the customer and the respective business owner.

Sakhi is not a party to any agreement or transaction entered into between users.

3 No Verification or Endorsement

Unless specifically mentioned by Sakhi under an official verification programme (if introduced in the future), Sakhi does not independently verify, investigate, certify, endorse, inspect, guarantee or warrant:

  • the identity of businesses;
  • ownership of businesses;
  • qualifications or professional credentials;
  • licences or registrations;
  • legality of products or services;
  • quality, safety or suitability of products;
  • pricing or discounts;
  • availability of products or services;
  • delivery timelines;
  • business claims;
  • customer testimonials;
  • advertisements or promotional statements.

Customers should exercise their own judgement and conduct appropriate due diligence before entering into any transaction.

4 No Warranty

The Sakhi platform, website and services are provided on an “as is” and “as available” basis.

Sakhi makes no representation or warranty, express or implied, regarding:

  • uninterrupted availability of the website;
  • accuracy of listings;
  • completeness of information;
  • reliability of content;
  • website uptime;
  • search rankings;
  • enquiry generation;
  • lead generation;
  • website traffic;
  • customer acquisition;
  • sales;
  • business growth;
  • return on investment;
  • social media reach;
  • advertising performance;
  • SEO rankings.

5 Business Listings

Sakhi shall not be responsible for:

  • incorrect business information;
  • outdated contact details;
  • pricing errors;
  • typographical errors;
  • expired offers;
  • discontinued products;
  • inaccurate descriptions;
  • misleading advertisements;
  • fake claims;
  • copyright violations by members;
  • misuse of uploaded content by business owners.

Businesses are solely responsible for maintaining accurate and lawful listings.

6 Customer Decisions

Customers acknowledge that all purchasing decisions are made entirely at their own discretion.

Sakhi shall not be responsible for:

  • dissatisfaction with products or services;
  • poor workmanship;
  • delays;
  • cancellations;
  • defective goods;
  • incorrect products;
  • damaged goods;
  • warranty disputes;
  • refund disputes;
  • payment disputes;
  • fraud committed by businesses;
  • professional negligence;
  • breach of contract by businesses.

7 Third-Party Services

Sakhi may provide links to third-party websites, payment gateways, social media pages, messaging platforms, maps, business websites or external services.

Sakhi has no control over such third-party services and accepts no responsibility for their availability, security, functionality or content.

8 Website Development & Digital Services

Where Sakhi provides website development, digital marketing, branding, SEO, social media management, content creation, AI-assisted content, advertising or related services:

  • services are provided according to the agreed scope of work;
  • timelines may vary depending on client approvals and third-party providers;
  • search engine rankings cannot be guaranteed;
  • social media performance cannot be guaranteed;
  • advertising results cannot be guaranteed;
  • lead generation cannot be guaranteed;
  • business growth cannot be guaranteed.

Any estimates, projections or recommendations are indicative only and shall not constitute a guarantee of future performance.

9 Technical Interruptions

Sakhi shall not be liable for interruptions arising from:

  • internet failures;
  • server downtime;
  • software bugs;
  • cyber attacks;
  • hacking attempts;
  • viruses;
  • maintenance activities;
  • hosting failures;
  • domain issues;
  • payment gateway failures;
  • telecommunications failures;
  • power outages;
  • government restrictions;
  • force majeure events.

10 Maximum Liability

To the maximum extent permitted under applicable law, the total cumulative liability of Sakhi, its founders, directors, employees, representatives, consultants, volunteers, partners and affiliates arising out of or relating to the use of the platform or services shall not exceed the total amount actually paid by the affected member to Sakhi during the twelve (12) months immediately preceding the event giving rise to the claim.

11 Exclusion of Consequential Damages

To the fullest extent permitted by law, Sakhi shall not be liable for any:

  • indirect loss;
  • consequential loss;
  • incidental loss;
  • exemplary damages;
  • punitive damages;
  • loss of profit;
  • loss of revenue;
  • loss of goodwill;
  • loss of opportunity;
  • loss of reputation;
  • business interruption;
  • loss of anticipated savings;
  • data loss;
  • corruption of data;
  • loss arising from reliance on information published on the platform.

12 User Acknowledgement

By registering on, accessing or using the Sakhi platform, the user acknowledges that they have read, understood and accepted this Limitation of Liability clause and agree that the allocation of risk contained herein is fair and reasonable and forms an essential basis of the relationship between the user and Sakhi.
